User Agreement: Coach

1. Introduction
My Coaching Place Ltd

You are entering into this User Agreement with My Coaching Place Ltd (also referred to as “we”, “us” and “our”).

Reference to ‘User(s)’, ‘you’ and ‘your’ mean the coach who is entering into this User Agreement.

Reference to the ‘platform’ means My Coaching Place web platform.

This User Agreement combined with the Agreed General Terms and Conditions, together form the basis of our relationship.

All Coaches Responsibilities

1.1 Users are responsible for their own security in conjunction with our services, both online and offline.

1.2 Users are solely responsible for the material they post on the Website, including messages sent, and they must not post defamatory, offensive or illegal material.

1.3 Users are responsible for their own internet security when using the Website.

1.4 Users must contact us immediately if they believe their password has been compromised. Users will be responsible for the actions of any interactions conducted in their name until they have notified us that they believe their password has been compromised and we have acknowledged receipt of this.

1.5 Users must not use the Website with the intention of disintermediating My Coaching Place in any way. Users must not promote opportunities or services of any company other than My Coaching Place on the Website.

2. Coaches “doing matching” Responsibilities

2.1 Coaches are not employees of My Coaching Place and are solely responsible for their own actions both on and off the Website.

2.2 Coaches are responsible for ensuring that the personal information they provide and their personal statements on the platform are accurate and in no way misleading. They must update this information promptly to maintain its accuracy.

2.3 Coaches must declare that they are in possession of relevant and current professional indemnity insurance prior to completing their profile on the platform.

2.4 Coaches are responsible for selecting the correct cohort and business school/university/training provider where they are/have been in attendance. If the relevant cohort or business school/university/training provider is not featured the coach can contact info@mycoachingplace.com to discuss options.

2.5 Coaches agree to make themselves available for between 1 and 4 coachee assignments where an assignment consists of a set number of sessions and duration by MCP (e.g. 6 x 90 minute coaching sessions) at intervals agreed between the coach and coachee. Coaches agree to notify MCP if there are any changes to the package structure: duration or number of sessions.

2.6 Coaches are providing their time and expertise for coaching assignments without any form of payment on the understanding that My Coaching Place is providing a platform where coaches and coachees connect.

2.7 Coaches will be presented as potential ‘matches’ for coachees based on criteria contained within their profiles. No guarantee is provided that coaches will either be presented as possible matches for coachees or chosen by coachees.

2.8 If/when you receive a connection request from a coachee you can view their profile and decide whether to accept or decline the connection request. If you accept the request from the coachee, they will appear on the connections section of the platform.

2.9 If you receive a connection request from a coachee you have 7 days to respond. If you don’t respond the request will automatically be declined and your profile will be set to unavailable so you will not be presented as a potential match for any other coachees. If this happens and you wish to remain visible to potential coachees, you should log in to the platform and change your status to ‘available’.

2.10 Once you accept a connection request from a coachee you should arrange an initial call or video call to get to know each other, discuss the coachee’s requirements and make sure you both feel that you are a good ‘fit’ to work together. At this point it is the coachee’s responsibility to share their sponsors details with you (where one exists).

2.11 Where a sponsor does exist, you should communicate with them directly to gain their input into the coaching contract and to agree with them how you and the coachee will communicate progress. It is standard practice for the coach, coachee and sponsor to check-in after the third and again after the final session. As your conversations with the coachee are covered by confidentiality, it is the coachee’s responsibility to share feedback with the sponsor and for the coach to observe and adopt any relevant feedback into the remainder of the coaching sessions.

2.12 Prior to commencing your first coaching session, you should complete My Coaching Place ‘Coaching – Our Guide to Working Together’ agreement for all coach/coachee assignments, the coach by assigning this task to the coachee is “signing” the agreement, and the coachee will complete this and this will act as a “signature”. ‘Coaching – Our Guide to Working Together’ can be found within the ‘Resouces’ Module and can be assigned as a Task.

2.13 Coaches should make bookings for sessions within the platform. This helps to log coaching hours and also sends an automated confirmation email to the coachee.

2.14 Coaches agree not to solicit Coachees or disintermediate My Coaching Place, or attempt to solicit Coachees or disintermediate My Coaching Place, in any way, from the first point of contact with any Coachee, during any period of confirmed bookings with any Coachee or at any time within 12 months of the date of the most recent booking with the relevant Coachee (the "Coach Restriction Period").

2.15 Coaches should complete the maximum sessions stipulated on their package (e.g. 6 x 90 minute session) with any one coachee. If further sessions are deemed appropriate, the coach and/or the coachee/ the coachee’s organization should contact My Coaching Place directly to discuss options.

2.16 You have the right to terminate provided that you notify the coachee, My Coaching Place Ltd and the Sponsor (where one exists), 4 weeks prior to the next scheduled coaching session. Very occasionally and for whatever reason coachees may feel that the desired level of progress is not being made. In these circumstances they may terminate the connection at any point. 

2.17 After the 6th and final session with a coachee and when adding notes to your session detail you should answer the question ‘are you continuing with this coachee’ as ‘no’. This will release your availability to take on more coachees (if you were at your maximum as selected). You can change the number of coachees you want to be available for at any time.

2.18 Any Coach who, in the opinion of My Coaching Place (which need not be reasonable), fails to comply with these terms and conditions may be immediately barred from using the Website and related services.

2.19 Coaches should inform My Coaching Place in writing and within 72 hours of confirming if they are leaving their coach training programme prior to its successful completion.

2.20 If you no longer wish to be visible to coachees on the platform you should sign in and change your status to unavailable. If you wish for your profile to be deleted from the platform you should email info@mycoachingplace.com.

3. Subscription and Pay as you go

3.1 At registration, coaches get gifted credits by My Coaching Place, these have a validity of 6 months. For more information on how credits work, go to Subscription Terms

3.2 Coaches that go through matching receive a credit for every coaching session they do through the platform. These credits expire after 6 months. For more information on how credits work, go to Subscription Terms

 

3.3 Subject to having valid credits, My Coaching Place shall, during the validity of the credits, provide you, the Coach, with a non-exclusive, non-transferable, non-outsourceable, revocable, discretionary licence to permit the authorised use and access to the Service for your business requirements; and agree to perform support and customer services during designated business hours (as determined by us). 

3.4 Fees and charges are non-cancellable and generally non-refundable. Claims and requests for fee refunds will be reviewed on a case-by-case basis and will depend entirely on the specific circumstances. 

3.5 For Services that are billed on a subscription basis (“Subscription(s)”). You have the option to enter into an Annual Subscription, for which you will pay your annual Subscription Charge upfront. You also have the option to choose a Monthly subscription, which is a 30-day rolling contract. In the event you choose to pay for your subscription monthly, you will be billed once on a monthly basis, on or around the date of service commencement anniversary each month, and on each subsequent month thereafter for the duration of the agreement. 3.6 The Charges are exclusive of value added, sales, use or withholding, or equivalent taxes in any jurisdiction (“Taxes”), which if payable, will be additionally payable by the User at the corresponding rate. Users shall be responsible for, and will not withhold or deduct, any applicable Taxes on the Charges. 

3.7 Payment Issues​: In the event that My Coaching Place is not able to obtain payment of any monthly subscription charge from a User, My Coaching Place will inform you upon becoming aware of the missed payment, and may suspend your access to the system until a suitable payment option is made available, through which My Coaching Place can secure Subscription Payments from.

3.8 My Coaching Place has the right to increase the amount of Charges payable for the Service at the start of each Subscription renewal period, when possible, we will give 30 day’s prior notice to the User by email. 

This Agreement is effective as of 13th of September 2023.
